Terms of use

These general terms and conditions of sale are agreed between the company ELLIPSE FITNESS UNIPESSOAL LDA, headquartered at Rua Visconde Gemunde, nº671 4760-392, VNFamalicão with the tax identification number 514 071 079 and contact +351 252 080 647, hereinafter designated “YOURFIT PROGRAMS®" and people who wish to make purchases through the website www.yourfitprograms.com hereinafter referred to as "User".

Object:
The present General Terms and Conditions of use are intended to define the conditions of access and navigation on the website by the customer who wishes to make purchases at the online store. The General Conditions of Sale aim to regulate the terms of operation of commercial transactions carried out between YOURFIT PROGRAMS® and the Client. The Privacy Policy aims to identify privacy protection measures with regard to the processing of personal data and the free movement of personal data, including the tools for personalized management of personal data provided by customers.
1 - General Conditions of Sale:
Order and Purchase Process
Deadline and Payment Methods - After completing the order process in the customer's personal account, the customer has a period (24 hours), selecting the payment method, to proceed with the payment. After this period, the order will be canceled.
1.1 YOURFIT PROGRAMS® offers the following payment methods for purchases made in the online store:

The customer will be able to pay by credit card and enjoy the advantages of liquidity and payment terms offered by his bank.
All transactions on our website are secure.
-MBWAY
The customer will be able to pay for their purchases through the MBWAY application.
-Paypal
Paypal payment is a secure method used worldwide. For more information on this payment method, visit www.paypal.com.
Save data for future Paypal transactions:
By subscribing to this option, the customer will not need to access the Paypal page in a next purchase. The amount of the purchase in question will be automatically debited from the Paypal account used when subscribing this option.
-Multibanco
ATM payments can be made through the ATM network or through your Homebanking.
At the end of your order, an ATM reference will be generated. The customer will receive this reference in the order confirmation email.
To pay at an ATM, the customer must select the "Payment for Services / Purchases" option and enter the corresponding entity, reference and amount.
If, after 24 hours, the customer has not made the transfer, the order will be canceled.

2. Types of personal data collected
In general terms, personal data are collected in three situations directly resulting from the activity of YOURFIT PROGRAMS®:
2.1 User registration: creation of YOURFIT PROGRAMS® client account and data processing purposes:
For the purpose of creating the client account, a personal area is made available in which the client must enter the necessary data for his identification as a client. The completion of the first purchase will depend on the provision of additional personal data, which are indispensable for the processing of the order and the respective delivery.
Mandatory fields in the forms available for those registration phases are marked with an asterisk (*).
YOURFIT PROGRAMS® is committed to protecting customer data and it will never be made available to third parties without the owner's knowledge or consent, as legally required.
When processing the customer's order, it is possible that certain personal data (such as the address and postal code) are disclosed to third parties for the sole purpose of preventing and detecting fraud and always following the interpellation for that purpose by the competent authorities.

In addition, when making a purchase on the website, you will also be asked for data regarding the delivery address and payment details, in order to guarantee the greatest possible efficiency and the fulfillment of delivery deadlines.
The data provided will be kept for the strictly necessary period, which normally corresponds to the period of existence of the customer account. For this reason, the moment the customer triggers the cancellation of the customer's account, the personal data will be permanently erased, with the exception of the data necessary to comply with legal obligations that will be filed in a specific database for that purpose and for the time absolutely necessary. required. If you wish to place a new order on the website, the customer must proceed with a new initial registration, subject to the terms and conditions in force on the date of the same.
We may also collect other information about the customer's experience on the website for the sole purpose of improving the service to be provided to the customer, which we will do after confirmation of knowledge and, when necessary, after the express consent of the holder of the personal data.
In terms of updating customer data, whenever you want to check the data you provided to YOURFIT PROGRAMS®, ​​the customer can do it in his personal area. The client must keep the access data to his account secure, since any and all actions or requests made through his account will be his responsibility, provided that the procedures for validating the client's identity described below are fulfilled.
We recommend that the customer does not store his password in the browser, as someone else with access to his computer can access his personal information.

RETURN CONDITIONS

1. RETURN OF DEFECTIVE PRODUCTS:

The customer is entitled to a refund if the products supplied are found to have defects or other non-conformities in relation to the items ordered. The defect must be communicated within a maximum of 24 hours after receipt of the product to the email info@yourfitprograms.com. The customer must attach in the e-mail photographs that prove the non-conformity of the packaging / product. The return can be made within 15 days after notification of the defect against the presentation of the original invoice and the product must keep all the original elements. The seller will proceed with the analysis of the returned product and inform the user of the right to the respective refund (if applicable), or exchange for the same or another product depending on the customer's option (taking into account that a possible exchange for an item of higher value) , the customer will have to pay the difference). As a rule, the seller proceeds to a refund within 15 working days from the date of confirmation via e-mail of the right to a refund. For returns and exchanges, the customer must request it through the email info@yourfitprograms.com.

If the defect or non-conformity is confirmed as the reasons justifying the return, the entire amount paid will be refunded.

The refund of the amount paid will be made by bank transfer.

These provisions do not affect your statutory rights.

The right to return only occurs, provided that the products:

- They have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories but cannot use them.
- Maintain the original characteristics and the packaging is not damaged (the carefully opened packaging will not be considered damaged).
- Be complete (eg both items in a pair must be returned).
- Have not been tampered with and keep the identification tag, if the product has this tag.
- All items that are manufactured by customization are not eligible for return.

2. RETURN FOR WITHDRAWAL:

The customer may, if not satisfied with the products supplied, return it within 15 calendar days after receipt, upon presentation of the original invoice. As a rule, the seller proceeds to a refund within 15 working days from the date of confirmation via e-mail of the right to a refund. The right to return only occurs, provided that the products:

- They have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories but cannot use them.
- Maintain the original characteristics and the packaging is not damaged (the carefully opened packaging will not be considered damaged).
- Be complete (eg both items in a pair must be returned).
- Have not been tampered with and keep the identification tag, if the product has this tag.
- All items that are manufactured by customization are not eligible for return.
The customer is responsible for the costs of returning and shipping the returned goods.

3. RETURN OF OFFERS:

The return of a product offered must be made by the person who offered it / bought it, with presentation of the original invoice.

If the defect or non-conformity is confirmed as the reasons justifying the return, the entire amount paid will be refunded. The refund will be made to the debit or credit card used to make the purchase or by bank transfer.

4. EXCHANGE BY SIZE OR OTHER ITEMS:

To exchange an article for another article, it is necessary to request the exchange through the email info@yourfitprograms.com.

An item can only be exchanged for another one of equal or greater value and the products can only be exchanged once. If after the exchange order you are not satisfied, you will only be able to return your order and place a new order.

The customer is responsible for the costs of returning and shipping the returned goods. The return must be accompanied by the original invoice.

The right to exchange only occurs, provided that the products:

SHIPPING & CARRIERS

We deliver orders from Monday to Friday. No shipments are made on certain holidays (confirmation can be obtained by sending an email to info@yourfitprograms.com). We guarantee delivery of an order if the address is a home or place of work and deliveries are not made to PO Boxes.

The preparation and dispatch of the warehouse order can take up to 2 business days (5 business days for large orders) after payment confirmation.

COVID-19 NOTICE: The estimated order preparation and dispatch time is 2 to 5 working days, currently.

After dispatch, delivery time varies depending on location and carrier.

1. SHIPPING SHIPPING

Shipping costs are automatically calculated by our system and depend on the following factors:
- Actual weight of the order;
- Carrier's tariffs, which undergo periodic updates;
- Customer shipping address.

TRANSPORT TIMES

YOURFIT PROGRAMS works in partnership with carriers so that the following shipping times can be ensured. However, these may vary for reasons beyond YOURFIT PROGRAMS.

- Continental Portugal: 2 working days (5 working days for large orders)
- Islands (Azores / Madeira): Between 5 to 8 working days.
-Spain: 3 working days (5 working days for large orders).
-Germany, Austria, Belgium, France, Netherlands, Italy, Luxembourg, United Kingdom weekly shipments on Friday delivery up to 7 working days.
-Denmark, Finland, Ireland, Norway, Sweden, Switzerland: weekly shipments on Friday delivery up to 7 working days.
-Bulgaria, Slovakia, Slovenia, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Romania: weekly shipments on Friday delivery up to 7 working days.

Christmas and New Year:
In order to ensure that you receive your order before the 25th of December, it must be made and paid by 3pm on the 20th of December for deliveries in Portugal and Spain. Until December 8th for deliveries in France. For deliveries outside this area, orders must be placed and paid by 3pm on December 7th.

Orders placed between the 25th of December and the 3rd of January may suffer delays.
